ABOUT

NEO-SOCIAL is a Membership-based social experience app designed to help Members create a social life that meets their needs and that of those around them.

1. INTRODUCTION

1.1 NEO-SOCIAL ("us", "we", or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, and disclose information when you use our platform and related services (the "Services").

NEO-SOCIAL's products, features and offerings are available (a) through mobile applications, webpages and application programming interfaces ("Applications"); (b) off platform, including without limitation entry management, sponsorship and marketing; and (c) online through various NEO-SOCIAL properties ("Site(s)"). (a), (b), and (c) are collectively referred to as "NEO-SOCIAL Properties" or our "Services".

1.2 There are several key terms used throughout this Policy that are specific to the NEO-SOCIAL ecosystem. Below are a few important definitions:

a. ‘Members’ are individuals who sign up for our subscription services and hold an active Membership Subscription with NEO-SOCIAL. For the purposes of this Agreement, and solely to describe the rights of those who hold even temporary or limited access to our services, such as platform Guest Pass holders, event ticket holders, or those whose Membership has lapsed but still retain some access, we refer to this collective group as "Members" throughout this Policy.

b. Guests are individuals who access our services temporarily through a Guest Pass, without an active Membership subscription. Guest Passes are time-limited and are intended to provide a sense of the Membership Experience. Each Membership comes with its own Guest Pass for Member distribution.

c. ‘Collaborator’ (also referred to as ‘Event Designer,’ ‘Partner,’ or ‘Artist’) is an interchangeable term used to describe any user—such as event creators, organizers, venue operators, artists, promoters, or DJs—who is invited to use our Services to publish events for Member discoverability on the NEO-SOCIAL platform.

d. “Material” includes information, data, text, editorial content, design elements, look and feel, formatting, graphics, images, photographs, videos, music, sounds, other content and assets

NEO-SOCIAL is owned by NEO-SOCIAL LLC with its principal place of business in New York State.

2. PRIVACY STATEMENT

2.1 Application - This Privacy Policy sets forth our policy with respect to information that can be associated with or which relates to a person and/or could be used to identify a person ("Personal Data") that is collected from Users on or through the Services. We take the privacy of your Personal Data seriously. Because of that, we have created this Privacy Policy. Please read this Privacy Policy as it includes important information regarding your Personal Data and other information.

"Non-Personal Data" as used in this Privacy Policy is therefore any information that does not relate to a person and/or cannot be used to identify a person. When you interact with the Services, we may collect Non-Personal Data. The limitations and requirements in this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Data do not apply to Non-Personal Data.

3. COLLECTION OF PERSONAL DATA

When you use or interact with NEO-SOCIAL through its Services, we may collect Personal Data. Sometimes this will be on our own behalf and other times this will be on behalf of a Collaborator using our Services to run an event. This is an important distinction for purposes of certain data protection laws and is explained in more detail below.

4. INFORMATION COLLECTED FROM USERS

We collect information you provide directly to us, such as your name, email address, phone number, and payment information when you create an account, purchase tickets, complete assessments or communicate with us. We also collect information about the events you attend or are interested in, and any content you upload or share through the Services.

We may automatically collect certain information when you access or use our Services, such as your IP address, browser type, operating system, and device information. We may also collect information about your use of our Services, such as the pages you view, the links you click, and the searches you conduct.

5. INTERNATIONAL USERS

If you are accessing our Services from outside the United States, please be aware that your Personal Data may be transferred to, stored, and processed in the United States or other countries where our servers are located and our central database is operated. These countries may not have the same data protection laws as your jurisdiction. By using our Services, you consent to this transfer, processing, and storage of your information in the United States and other jurisdictions.

6. COOKIES AND TRACKING TECHNOLOGIES

We may use cookies, web beacons, pixels, and similar tracking technologies to collect information about your interactions with our Services, including your browsing behavior and preferences. You can control cookies through your browser settings and other tools. If you disable cookies, some parts of the Services may not function properly.

7. INFORMATION COLLECTED FROM MEMBERS

7.1 We collect Personal Data from both Members, sometimes for our own purposes and other times on behalf of a Collaborator who is using our Services to manage or host an event.

Information You Provide to Us:

If you are a Member, we may collect Personal Data such as your name, email address, phone number, and financial information (e.g., credit card number, expiration date, billing address) when you register for a paid event, create an account, complete assessments, or otherwise interact with the Services. Collaborators may also use our platform to set up event registration pages that collect additional information from you. Please note that NEO-SOCIAL does not control the content of these in-app registration forms or the Personal Data requested by Collaborators. When you register for or otherwise provide information in connection with a Collaborator’s event or activity—whether on your behalf or someone else’s—that information may be shared with the Collaborator and used in accordance with their policies.

7.2 Information We Obtain from Other Sources:

We may also collect or receive Personal Data from third-party sources. This includes Collaborators (in the case of Member data shared for event participation or communication), other Members (e.g., when one Member registers another), your credit card issuing bank, payment processing partners, third-party websites or marketing partners, financial institutions and other service providers. In each case, we only use this information in accordance with this Privacy Policy and applicable data protection laws.

7.3 In addition to the above, we may collect Personal Data when you register for events, complete assessments, express interest in Collaborator-hosted experiences, or upload content through the Services. Collaborators may also create custom event registration forms that collect additional Personal Data beyond what NEO-SOCIAL requests directly. This information may include data you submit on behalf of another person (such as a guest). When you interact with a Collaborator’s event or activity, any Personal Data you provide may be shared with that Collaborator and used in accordance with their own privacy practices. NEO-SOCIAL does not control the information Collaborators choose to collect or how they use it, and we encourage you to review the applicable privacy policies of any Collaborators or affiliated third parties involved in your interactions.

8. NEO-SOCIAL SOCIAL EXPERIENCE ASSESSMENTS, HEALTH AND HEALTH-RELATED DATA

Some of the elements that make up NEO-SOCIAL are in place, including in-app social experience assessments are in place to help make certain social health-related insights more accessible and useful to Members. 

We recognize that the information you provide through our psychology-based assessments may be sensitive and personal in nature. While NEO-SOCIAL is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), we apply safeguards consistent with HIPAA’s spirit and intent to protect the confidentiality and security of such data.

Your individual responses are used to provide you with a personalized dashboard of metrics that only you can access. We may also combine responses from many members in a de-identified, aggregated form to generate broader insights. These broader insights may be shared with Members, Collaborators, or outside parties, but never in a way that identifies you personally. Individual metrics and results are only visible to the Member they belong to, and personally identifiable assessment data will never be shared without your explicit consent.

All assessment data is transmitted and stored using industry-standard encryption and is protected through strict administrative, technical, and organizational safeguards. These measures are designed to prevent unauthorized access, disclosure, or alteration of information. We treat all assessment data with the same heightened level of protection afforded to health-related information to ensure data safety and protection.

9. DEVICE PERMISSIONS

Certain features of our mobile application may require access to your device’s location, camera, microphone, or contact list. We will request your permission before accessing this information and you may choose to deny or revoke access through your device settings at any time.

10. USE OF PERSONAL DATA

We collect and use the Personal Data we collect in a manner that is consistent with this Privacy Policy, and applicable privacy laws.

We may use the information we collect to provide and improve our Services, communicate with you about your account and events, send you promotional emails and newsletters, and personalize your experience. We may also use the information for research and analytics purposes, and to comply with legal obligations.

11. SHARING INFORMATION

11.1 BACKGROUNDWe are not in the business of selling your Personal Data. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third party advertisers. There are certain circumstances in which we may disclose, transfer or share your Personal Data with certain third parties without further notice to you, as set forth in this Privacy Policy.

We may share your information with Collaborators and venues, payment processors, service providers, and other third parties as necessary to provide the Services. We may also share your information in response to legal requests, to protect our rights or the rights of others, or in connection with a business transaction that helps us uphold the Services we provide to Members and Collaborators.

11.2 PARENT COMPANIES, SUBSIDIARIES AND AFFILIATES - We may also share your Personal Data with our parent companies, subsidiaries and/or affiliates for purposes consistent with this Privacy Policy. Our parent companies, subsidiaries and affiliates will be bound to maintain that Personal Data in accordance with this Privacy Policy.

11.3 AGENTS, CONSULTANTS AND SERVICE PROVIDERS - We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of NEO-SOCIAL to perform certain business-related functions. These companies include our marketing agencies, online advertising providers, data enhancement and data services providers, database service providers, backup and disaster recovery service providers, email service providers, payment processing partners, customer support, tech support, hosting companies and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.

11.4 COLLABORATORS - When you register for or attend an event, sign up for communications, enter a contest, transfer a ticket, or otherwise provide your Personal Data (such as through a web form), that information—including the Personal Data of any transferees—will be shared with the Collaborator and may also be shared with other third parties involved in or promoting the event.

In some cases, a Collaborator may authorize a third party (“Third Party Collaborator”) to create or manage an event page on their behalf. For example, a concert venue might allow a promoter to use its NEO-SOCIAL account to create and host events. In such cases, we may share your Personal Data with those Third Party Collaborators.

If you are part of a Collaborator's organization within NEO-SOCIAL, your Personal Data may be accessible to the Collaborator and to any Third Party Collaborators they authorize.

We are not responsible for how Collaborators or their appointed Third Party Collaborators handle your Personal Data. Please review their individual privacy policies before sharing your information.

11.5 LEGAL REQUIREMENTS - We may disclose your Personal Data if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.

12. PERSONAL DATA STORAGE

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via the Services from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration and destruction. However, no network, server, database or Internet or email transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

13. ACCESS, UPDATE OR CORRECT YOUR PERSONAL DATA

You may update or correct your Personal Data at any time by logging into your account. You may also unsubscribe from promotional emails by following the instructions in the email or contacting us directly.

If a Member requests that their Personal Data be deleted, NEO-SOCIAL is authorized to delete such information from the Services even if that means removing its availability to the Collaborator through the Services. However, if you are a Member, you understand that even if NEO-SOCIAL deletes upon your request or pursuant to this Policy, your Personal Data may still be available in the Collaborator's own databases if transmitted to the Collaborator prior to NEO-SOCIAL receiving or taking action on any deletion.

14. PERSONAL DATA RETENTION

We may retain your Personal Data as long as you are registered to use the Services. You may delete your account through your profile settings. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes. For Collaborators, we retain your data as long as we maintain a relationship with you and for a limited period of thereafter as necessary to meet business and legal requirements.

15. PERSONAL DATA OPTIONS

You may update or correct your account information at any time by logging into your account. You may also unsubscribe from promotional emails by following the instructions in the email or contacting us directly.

16. EXCLUSIONS

16.1 Personal data provided to others - This Privacy Policy does not apply to any Personal Data that you provide to another User or visitor through the Services or through any other means, including to Collaborators on event pages or information posted by you to any public areas of the Services.

16.2 Third party site - This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by us (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

17. CHILDREN - CHILDREN’S ONLINE PRIVACY PROTECTION ACT

We do not knowingly collect Personal Data from individuals under the age of sixteen (16). If you are under the age of sixteen (16), please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Services without their permission. If you have reason to believe that a child under the age of sixteen (16) has provided Personal Data to us through the Services, please contact us at QUESTIONS@NEO-SOCIAL.APP and we will endeavor to delete that information from our databases.

18. CHANGES TO THIS PRIVACY POLICY

We reserve the right, in our sole discretion, to update or modify this Privacy Policy at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the change becoming effective. Your continued use of our Services after the effective date of the revised Privacy Policy constitutes your acceptance of the terms.
